By accessing or using the Japan Power Market platform (the "Service"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, please discontinue use of the Service immediately. The Service is operated by PowerTrade LLC (the "Company").
The Service provides data, analysis, and information related to Japan's electricity market, including but not limited to JEPX spot market prices, EPRX reserve capacity prices, regional electricity prices, trading volumes, and market trend analysis. All content provided through the Service is for informational purposes only and does not constitute investment, trading, or financial advice.
All data, analyses, forecasts, and information provided through the Service do not constitute investment advice, trading advice, or financial advice. The Company is not responsible for any trading or investment decisions made based on the content of the Service. Electricity markets are highly volatile and past market performance does not guarantee future results. Users assume all risks associated with using Service information for trading decisions and should consult qualified professional advisors before making any significant financial decisions.
Certain features of the Service require creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify the Company immediately of any unauthorized use of your account. The Company reserves the right to terminate accounts for violations of these Terms.
The Service offers both free and paid subscription plans. Paid subscriptions are automatically renewed at the selected billing cycle (monthly or annual) until cancelled. All fees are denominated in Japanese Yen, exclusive of applicable taxes. Refunds are governed by the Company's then-current refund policy. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
The Service and all its content (including but not limited to text, charts, data visualizations, software, and trademarks) are the property of the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, sell, or sublicense any part of the Service without the Company's express written authorization.
You agree not to: (a) use the Service for any unlawful purpose; (b) access the Service's systems or networks without authorization; (c) scrape, crawl, or bulk-extract Service data through automated means; (d) interfere with or disrupt the normal operation of the Service; (e) impersonate others or provide false identity information; (f) distribute malware or harmful code; (g) circumvent any access controls or security measures of the Service.
The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, the Company is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, even if the Company has been advised of the possibility of such damages. The Company's total liability to you shall not exceed the fees paid by you to the Company in the 12 months preceding the claim.
The Service may contain links to third-party websites or resources. The Company assumes no responsibility for such third-party content and makes no warranties regarding its accuracy, legality, or appropriateness. You access third-party links at your own risk.
The Company reserves the right to modify, suspend, or terminate the Service (or any part thereof) at any time without notice. The Company shall not be liable to you or any third party for any losses resulting from such modification, suspension, or termination.
The Company reserves the right to revise these Terms at any time. Revised Terms will be posted on this page with an updated effective date. Registered users will be notified of material changes by email. Continued use of the Service constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails to resolve the dispute within 30 days, the dispute shall be submitted to the Tokyo District Court as the court of first instance.
